Freightshop terms and conditions for freight carriage and related services.

Notice: Carrier Liability

Where international carriage is involved, liability for loss, damage or delay may be governed by the Montreal Convention or Warsaw Convention. Unless a higher declared value is accepted, liability limits apply as set out in the contract conditions.

Core Contract Conditions

  1. Carriage is subject to applicable convention liability rules, laws, regulations, tariffs and carrier conditions of carriage.
  2. Carriers may alter stopping places, routing, aircraft or modes of transport where reasonably required.
  3. Claims for loss, damage or delay are subject to strict time limits and written complaint requirements.
  4. Shippers are responsible for lawful packing, documentation and compliance with all applicable regulations.
  5. Liability exclusions and limits apply to carriers, agents, employees, subcontracted equipment and representatives.

Claims and Time Limits

  • Damage claims: immediately on discovery, and no later than 14 days from receipt.
  • Delay claims: within 21 days from cargo being made available to the entitled party.
  • Non-delivery claims: within 120 days from air waybill issue (or cargo receipt if no air waybill).
  • Court action for damages: generally must be brought within 2 years under the contract terms.

Australian Consumer Law

These terms are subject to rights under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)). Nothing in the terms is intended to exclude rights that cannot be excluded by law.

Where permitted by law and where reasonable, liability for breach of applicable guarantees may be limited to re-supply of services or payment of the cost of re-supply.
